What is this Privacy Policy for?

Law No. 13,709 of August 14, 2018, as amended, (“General Data Protection Law” or “LGPD”) has established several requirements and obligations that must be implemented for personal data processing activities.

Many of these requirements and obligations aim to: (i) process personal data in an adequate manner; (ii) protect personal data from improper access or processing; and (iii) avoid the risk of leakage or other internal failures that may generate damages to the data subjects; among others. There are several measures that must be adopted by the processing agents to demonstrate that these activities are carried out considering the best practices in relation to the processing and focusing on the protection of the data subject.

This is the Privacy Policy of IOXtream (“Policy” and “IOXtream”, respectively) and it applies to interactions conducted between customers, suppliers and other interested parties and IOXtream through its official website ioxtream.io (“Platform”). By accessing ioxtream.io, setting up your IOXtream account or using the IOXtream Services, you are accepting the practices described in this Privacy Policy, to the extent permitted by law..

This Policy sets out the guidelines relating to the protection of personal data and explains in a transparent manner how IOXtream handles the personal data that users of the Platform (“You”) provide through it..

Each capitalized term used in this Policy is a defined term and has the meaning ascribed to it in the Policy.

1. Commitment to the security of your data

IOXtream protects your Data when You browse, access or use the Platform with a view to using the services provided by IOXtream (“Services”). IOXtream is committed to the security of Your Data throughout the process of browsing the Platform, using the Services and sending a support request to IOXtream. Therefore, your Data will be kept in the strictest confidence and will not be sold, exchanged or disclosed to any third party, except in the cases expressly established in this Policy.

2. When do we collect your Data and what Data is collected?

We collect certain information when you use IOXtream. This includes information that You provide, information that we automatically collect, and information that we receive from other sources.

2.1. Information provided by You

We collect Data provided by You directly when You use the Services. This includes:

Account information. When you create an account on IOXtream, you will be required to connect through an external platform or solution and provide a way to contact you (such as email). To access certain features, you may need to add other information to your account.
Content You create. This includes any content that You upload to the Platform. For example, You may write messages or upload images and videos through the Platform. This also includes your profile information and information that You provide to the Platform. In general, we do not store the content of live streams, only certain moments that You interact with the Platform. If we want to change this in the future (for example, to facilitate content moderation), we will disclose our decision to You in advance.
Information for non-fungible token purchases. If You purchase any Paid Services through IOXtream, You will need to submit your Cardano virtual wallet (ADA) information in order for the transfers to be validated.
Information about your activities. We collect information about your use of the Services and activities on the Platform.
Information used to enable optional features. Certain features, such as connecting through an external platform or solution, may require You to provide additional information (or grant us access to that information) to make them work. This also includes information about third party integrations that you choose to enable and the data that you allow these third party services to share with us. For example, when you link a streaming account, we may collect information about that account in order to display that information on your profile (if you choose to do so).
Other information provided by you directly. You may choose to submit additional information when using IOXtream. You may participate in surveys where you can provide product feedback or submit information to our IOXtream support teams.

2.2. Information we automatically collect

We also collect information automatically when you use our Platform and Services. This includes:

Information about your device. We collect information about the device You use to access the Platform. This includes information such as your IP address, operating system information, browser information, Services accessed, interactions performed, information about device settings, technical data such as URL and geolocation information.
Information about your use of the applications or websites. We collect log and event information related to how and when you use our Services (such as the pages You visit and devices You set up).
Other information we collect automatically. When you take certain actions on other websites, we may receive information about You. For example, when we advertise IOXtream on third party platforms, if you click on the ad, we may receive information about which ad you saw and on which platform. Similarly, we may also receive certain information when you click on a referral link, such as the originating website.

We may receive information from cookies (small text files placed on your computer or device) and similar technologies. Primary cookies are placed by us (and our third party service providers) and allow you to use the services, they also help us analyze and improve your experience and the services. The Services may use the following types of cookies:

Strictly necessary cookies: these are necessary for the Services to work. If You try to use tools to disable cookies, some parts of the Services may not function properly.
Functional cookies: these help us provide enhanced functionality on the Services, such as remembering language preferences. Disabling these features may affect some functionality.
Performance cookies: allow us or our third party analytics providers to learn how You and others use and participate in the Services, this way and with anonymized data, we are able to improve the experience of our Platform.

We may also use certain technologies to monitor the activities performed on the Platform, such as analytics tools or to trigger emails for notifications, updates and promotions. This and other tools may collect information such as how You visit the Platform, including which pages and when You visit those pages, other sites that have been visited previously, and other information.

2.3. Information we receive from third parties

We may receive information about You from other sources, including other users and third parties, and combine that information with other information we have about You. For example, if You interact with our social media account on another platform, we may receive certain information about You, such as your username on that platform.

2.3.1 YouTube API Services

IOXtream uses YouTube API Services to provide features integrated with the user's YouTube account. By connecting your YouTube account to IOXtream, you authorize us to access certain data as described below.

(i). Data collected through the YouTube API.
When you authorize the connection with your YouTube account, we may collect and store the following information:

YouTube channel username.
Email address associated with your Google account.
IP address.
Channel information (including name, ID, public statistics, and streaming data).
Subscriber information.
Any other data voluntarily provided by the user or made available through the API.

(ii). Use of data: This information is used exclusively to provide and enhance the services offered by IOXtream, such as live event features, audience interactions, statistics, and YouTube account-related customizations.

(iii). Google Privacy Policy: By using IOXtream with your YouTube account, you are also subject to the Google Privacy Policy, as required by Google's guidelines.

(iv). Revoking access and deleting data.
You may, at any time:

Revoke IOXtream's access to your YouTube account by visiting your Google account's security settings.
Request the deletion of data stored by IOXtream by sending an email to dpo@ioxtream.com. Once the request is received, your data will be permanently deleted, unless legal obligations require it to be retained for a specified period.

(v). Data retention IOXtream retains collected data only as long as it is necessary to provide the contracted services. After this period, the data is automatically deleted or anonymized from our systems in a secure manner, in accordance with applicable laws and best practices in data protection.

3. How Do We Use Your Data?

We may use your Data to fulfill, among others, the following purposes:

3.1. To fulfill our obligations to You

To provide the Services to You. We use your information to provide the Services. For example, we collect and store the messages You send and display them in the manner You direct. We also use the information You provide to create and manage your account and to facilitate transfers. When you enable optional features (such as connecting your IOXtream account to other platforms), we use the information from those services to enable those features.
Fulfilling our commitments to the IOXtream community. We care deeply about the security of your Data and work hard to try to make IOXtream a safe, positive and inclusive place. To do this, we use your information to monitor and take action against users and content that violate our IOXtream Terms of Service and Use and other internal policies. This includes responding to user complaints, detecting fraud and malware, and proactively scanning attachments and other content for illegal or harmful content. We also use certain information, which may include content reported to us and public postings, to develop and improve systems that can be automated to more quickly detect, categorize and take action against prohibited content or conduct.
Platform Customization. We use your information to provide, customize, and improve our Services. This information powers our discovery surfaces and helps us unlock new features and functionality for IOXtream.
Contacting You. We use your information to contact You regarding your account, such as verifying or protecting your account. We may also use your information to contact You about important functionality or policy changes, send You information about our Services, including new services or features that we think You might like, and information from transfers made or received by You. You may opt out of receiving marketing communications.
To provide service to You. We use your information to answer your questions about our Services and to investigate bugs or other problems.

3.2. For our legitimate business interests

Protection of our Services. We use the information to keep our Services secure and prevent misuse by enforcing our Terms of Service and Use, besides other policies against users who violate them.
Reporting on IOXtream performance. We use your information to track key metrics of our business, for internal reporting, and to respond to regulatory obligations.
Improving our Services. We use your information to help us understand how users interact with our Services, what features or products they may want, or to understand and improve our Services. This includes information about how You use our Services and how the servers are structured.
Advertising our Services on other platforms. We are proud of the Service we provide and the Platform we have built and invest money advertising it on other platforms to bring more users to IOXtream. As part of this, we use certain information to help deliver our advertising and measure the effectiveness of our own product ads, as well as improve these ads in the future.

3.3. To fulfill our legal obligations

We retain and use your information in connection with potential legal claims, when necessary, and for compliance, regulatory and auditing purposes. For example, we preserve information if we are required to do so by law or if compelled to do so by a court order or regulatory body. In addition, if You exercise any of Your applicable rights to access, change or delete Your personal information, We may request identification and verification documents to confirm Your identity.

3.4. For protection of a person's vital interests

We may collect or share personal data if we think someone's life is in danger, for example, to help resolve an urgent medical situation.

4. Where Do We Store Data?

The Data may be stored in our own servers or those of third parties hired for this purpose, whether they are allocated in Brazil or abroad, in accordance with the legislation applied, and may also be stored by means of cloud computing technology and/or other technologies that may arise in the future, always aiming at improving and perfecting our Services.

5. How long is your Data stored?

We retain personal information for as long as is necessary for the purposes for which we collected it. If your account is inactive for more than two years, we may delete it and delete or anonymize any personal information associated with your account.

6. With whom do we share the data?

The database is our property and responsibility, and its use, access and sharing, when necessary, will be carried out within the limits and for the purposes of our business.

We share Your Data only with third parties that (i) assist us in providing the Services; (ii) help us to meet the demands (questions, complaints and other requests) requested by You in our communication channels; and (iii) are necessary to conduct our business normally, within the limit of the previous paragraph.

We may also provide your personal information to third parties to keep our systems secure, or when necessary to protect your or our best interests.

We may also disclose your Data to police and government authorities or authorized third parties if and to the extent that we are required or permitted to do so by law, regulatory rule, or court order.

In general, the sharing of the Data occurs on these occasions:

When You tell us to do so. When You post public content on the Platform, You are telling us to share that information with certain communities, people or, in the case of public spaces, anyone who accesses them. We may also share your information as You instruct us or provide your consent to do so.
With our suppliers and/or contractors. We may share information with vendors and/or service providers that we hire to do specific work for us. This includes cloud providers, such as Amazon, who host our data and our services. We may also share limited information with advertising platforms to help us reach people we think will like our Service and to measure the performance of our ads shown on those platforms. We do this to help bring more users to IOXtream, and we provide only the information necessary to facilitate these services. This may include information such as whether You have installed our application or registered to use IOXtream.
Comply with the law. We may share information in response to a request for information if we believe disclosure is required by law, including to meet national security or public order requirements. Where permitted and feasible, we will attempt to provide You with advance notice before disclosing Your information in response to these requests.
In an emergency. We may share information if we believe in good faith that it is necessary to prevent serious harm to someone.
Invoking our policies and rights. We may share information if necessary to invoke our Terms of Service and Use or other policies, or to protect our rights, property and safety, and those of others.
With our related companies. We may share information with our related companies, including parents, affiliates, subsidiaries and other companies under common ownership and control.
Aggregated or De-Identified Information. We may share information about you that has been aggregated or anonymized in a way that cannot reasonably be used to identify You. For example, we may share aggregate user statistics to describe our business to partners or the public.

Please be advised that some of the IOXtream group companies and service providers with whom we share your Data may be located outside of Brazil. If your Data is transferred to another country, IOXtream will take steps to ensure that your personal information remains protected in accordance with this Privacy Policy, subject to the laws applicable in the countries to which it has been sent.

7. What are your rights with respect to your Data?

As established by the LGPD, You have rights and guarantees in relation to your Data. IOXtream provides mechanisms, detailed below, so that you have clarity and transparency to exercise your rights. When necessary, please contact our team for questions and requests.

8. How do we ensure the security of your Data?

We are genuinely concerned about the security of personal information and strive to protect the Data we keep in our records, however, we cannot guarantee complete security. Unauthorized access or use, hardware or software failure, and other factors may compromise the security of Data at any time.

Please note that the transmission of Data over the internet is not completely secure due to a number of factors, including network and operational factors, and IOXtream cannot guarantee the complete security of the Data transmitted. Although we will do our best to protect your Data, we cannot guarantee the security of your Data transmitted to our Platform. Any transmission is your sole responsibility, which, by agreeing to this Policy, you expressly acknowledge and assume.

Once Data is received by the Platform, we are committed to ensuring that such Data is secure. To prevent unauthorized access or disclosure of your Data, we have implemented appropriate physical, electronic, and administrative procedures to secure and protect the Data we collect.

Our efforts are aimed at mitigating risks of destruction, accidental or illegal loss, alteration, unauthorized disclosure or access, or any other form of illegal or unauthorized or inappropriate treatment.

9. Validity and Changes to the Privacy Policy

We will update this Privacy Policy over time. We will always indicate the date on which the latest changes were posted and, if the changes are significant, we will provide a more prominent notice as required by law, for example, by sending an email or highlighting the changes on our Platform.
